So as posted previously Dann called me on Monday February 18 and says "will get your order sent tomorrow "
As of today still nothing, 5 months now since I placed this order and twice I have been told order will be sent the next day. Thoughts anyone?

Get a refund and buy alternatives. If u must buy his stuff wait until it becomes available second hand.

I don't have to buy his stuff but saw his products which are without doubt first class and his reputation on here seemed excellent also, so rather than get someone local here in Adelaide I wanted to support a bloke who seemed to really look after the mx5 community. I sent my first enquiry via email and within 2 hours he responded by phone and that call was around 1.5 Hours long! I couldn't believe his knowledge and his generosity with his time. That was last October, the 18th, you know the rest of the story from there.

That's pretty sad to be honest.

I mean, I get that running a business is hard etc, but to keep a customer in the dark is really poor form.
Even a short followup email would be better than nothing just a "really sorry, we are absolutely overrun with work and have not had a chance to finish your order yet" would be better than silence.


As far as your action, personally, if I were dealing with a business that had done this, i'd be finding a way to make contact and just cancel the order and demand a refund.

If he avoids your calls, or says no to a refund, then it may unfortunately be time to speak with a lawyer.


I assume you've got an invoice etc from him showing what's been ordered, what's been paid, and estimated time for delivery?

Both these have 6 month limitations so you may be getting close to that, so do not delay ;
Paypal - you can ring them and put in a claim
Credit Card - visit your bank and do a chargeback
Direct deposit into an account - nothing you can do except ask him to refund

Also note that since it's a proper business these days (I assume going by his website, and the address being a factory, and him having a valid ABN), rather than Dann doing work from home, there's also the normal consumer protection laws etc.

It's worth noting, he is still active and running a business. A friend of mine had to send something back to him for repair and it was completed and returned pretty quickly. That was only in the past few weeks, so it's not like Dann's decided to can the business.


I'd still contact and give one more chance, but regardless, 5 months is excessive (unless the invoice said ETA 6months or whatever)

5 months for anything is unacceptable. I would've sought a refund after a few weeks (this allows him all sorts of lead time). If it was a retail business I would've got a refund almost immediately (as I give my customers when something is unexpectedly out of stock).

nice work Dann, i know what its like to be snowed under and finding it difficult to please a lot of people when you don't have lots of resources at your disposal. Its tough being the small guy some times.

To all, thanks for replies and advice, I appreciate it. I also am self employed so can understand Dann's situation however I think a heads up on expected delivery times, time blowouts etc can be very appreciated and cost next to nothing

Currently in a similar situation to the OP, been messaging Dann for weeks at a time but rarely get a reply. Paid for some stuff at the end of November but still nothing.
If any one talks to him could you point him to this thread, I've been real patient throughout the whole situation but it's starting to run thin.
