Yes that's the one. Tricky one. It's no good to beat him to death if he was 30 seconds unconscious before they stopped. Maybe he just got kicked once or twice, it's hard to say.

There seems to be more to that than meets the eye. That the accused does not seek bail suggests something (to me anyway).
That the victim dies of 'merely' a beating suggests either a prior medical condition, or the beating was in the gbh area (autopsy presumably will show if either, or both, the case).
Subsequent report confirms the gbh (see below), but nothing further appears to have occurred as whether, or to what extent, the beating contributed to his death. Also he did get bail later, but broke bail conditions, and apparently went back in.

A really good friend of mine was a witness to this murder. I think the court has heard evidence now so it is safe to say, publicly, some of what he told me.
If you are squeamish, stop reading now.
The accused and his friend chased the victim out of the accused's house down the street and caught him 50-100m away. They then laid into him, kicking and punching while a bunch of neighbours came out from various houses. The accused then put the victim in a choke hold and choked the guy to unconsciousness (and we now know death) over a period of minutes. This occurred *while* a group of people stood around them telling the accused to get off the victim "before he dies", as the victim was well restrained, unconscious and could not go anywhere, as they were by then surrounded by people. The accused did not let go of the choke hold, despite the neighbours yelling at him, until the victim was ummm, very unconscious. This is why the accused is in gaol. It was not an appropriate response according to civilised society and NSW law.

It's always tricky in terms of restraining an offender ..
A few years back a meth head laid into a random old guy walking out of the local shops (he was looking to fight anyone).
I put the druggie down and pinned him down with a wrist lock while others called the cops.
It then took the cops over 20 minutes to arrive, not comfortable for me and painful for the druggie. This put me at more risk then I was comfortable with.
With 3D printing and cheaper CNC it going to be harder and harder to keep guns off the street.

My other half saw some clown climb into our neighbors flat. she calls the cops. No joke within 90 seconds.... 7 police cars had descended unto this address in Manly.

Id personally never get involved like that Okibi. I admire your courage. apart from that I couldn't fight my way out of a wet paper bag.
