Question is if she has 3rd party property (or comprehensive) insurance or not. If it's 3rd party only...

She'll be in a world of pain soon. If she attempts to falling asleep at the wheel. She is stuffed. He insurance most likely wont pay for her car to be fix/replaced. Yours will be as a thrid party to her policy. And the courts will also hit her with driving without due car and attention.
Amd she's killed 2 cars ($20K+ bill) and got a dangerous driving record to her name. She'll be paying top dollar for car insurance for the next 5 years.
Sorry, every single thing you wrote here is incorrect and is in no way based on fact. It isn't even worth correcting

And the police wont put in the accident report that she admitted to falling alseep, and she wont have a day in court? And as I said also, I ain't the policeperson, so I don't know what will go into the accident report.
I'm not sure what level of education everyone has that uses this forum, but surely anyone reading can decide what it fact, opinion and/or hearsay from the way posts are typed.
It's one possible outcome that may happen. And there are many possible outcomes that may arrise from this point onwards.
AS for education you're spelling makes me think 5 class was the best 3 years of you life

The thing is, you didn't say it was your opinion, you stated it as fact. You then said it was a possible outcome, the thing is, it isn't even a possible outcome.
Interesting that you mention others' level of education when you post is littered with spelling mistakes and you do not know the difference between a "right off" and an insurance "write-off."
- Insurance covers people for accidents, falling asleep is an accident hence it will always be covered unless you have fallen asleep due to using medication with a warning label on it contrary to the instructions on the label. (I.E This medication may cause drowsiness, do not operate heavy machinery ETC)
- You said that the court will fine her for driving without due car and attention; First of all, it won't go to court. The police may fine her for driving without due care but what does that matter? It doesn't go on record anywhere and she doesn't need to tell her insurance company about it. In the next sentence you state that she will have "dangerous" driving on her record, they are two completely different things, she will not have "dangerous driving on her record."
- The fact that the bill was $20K+ (in your opinion) is irrelevant. Whether the claim against her is for $100 or $100,000 it will have the same effect to her claims history. You state as fact that she will be paying top dollar for insurance for the next five years. Doubt it. Especially if she is on a rating one for life or has a protected policy.
If it sounds like I am being rude, I hate it when people sprout off opinion and uneducated tripe on forums which thousands of people read, further confusing people about things they don't really understand anyway. If you don't know, don't comment, it doesn't do anybody any good in the long run.

I wasn't having a go at you personally. But since you wanna make it personal. Have a look at you own spelling...
No good picking up on someone elses mistake if only you make the same mistakes. I fixed some for you.

Nope never stated it as fact. Puting a possiblility in there makes it not fact. Sorry to have confused.AntHarmer wrote:The thing is, you didn't say it was your opinion, you stated it as fact. You then said it was a possible outcome, the thing is, it isn't even a possible outcome..

… hello kids, it's a Sunday (and it's not a school day), don't think we need another lesson on spelling and grammar, do we?
Can we now stop going off-topic and get back to the purpose of the thread?
If you wanna troll.. go move yourself to the OT thread

Glad you're all ok, sad to see such damage.
To everyone who thinks this is a grammar rodeo you're on the wrong forum.
This forum is about cars not commas, apostrophes or spelling. If you want to lock horns with someone over their use of the English language try a grammar forum, at least they might prove a more challenging opponent.
A fellow enthusiast just had a beautiful SE crashed into and possibly written off, lets show a little respect and goodwill.

If you had access to a car like this, would you take it back right away? Neither would I.

Re: so someone hit my SE yesterday
I think the only person to feel pain will be the OP
I "think" the routine (if not insured) is to get a letter of demand sent to the driver of the other car. The should sent it to their insurer for processing.
IN the mean time the OP needs to get photos of his car (inside and out) to prove if it is better/worse than market average. List all the options and prices. Then get evidence online of current SE prices.
This will then be used as evidence WHEN they lowball you on a price to negotiate a higher payout.
PS: Someone will say it... why didn't you insure your car?

Re: so someone hit my SE yesterday
I feel for you Sal.
There are circumstances where a crash is almost unavoidable but I'm guessing this was just inattention (yeah, probably the phone)
I sympathise with Members who have to park on the street. I hate leaving my car unattended. Last time I did it with the family hack I came back to find something had 'parked-by-ear' and then decided it couldn't get into the parking spot and drove off.
At least you didn't just come back to find it destroyed and the perpetrator gone.

Re: so someone hit my SE yesterday
this happened to me once. mine was rear ended and the bumper was flattened and the boot was squished a bit, looked about half as bad as yours. it was a write off.
this will be a write off (its very easy to bend the chasis in an MX5, if theres any creases to the body around the door frame it's probably a write off).
even if it's not your next car you'll get another red SE one day as a tribute to the one written off, and it'll be even better. ;)

Re: so someone hit my SE yesterday
If the car is insured you contact your insurer and they do the rest including the communication with the other party involved. Its true that many insurers take the Glass guide evaluations ( e.g. Shannons) and the value of the car should be shown on your Policy. The insurance co decides on whether its worth repair. Insurance co's have all the legal means at their hands.
