not sure where you are getting that from either, as i'm pretty sure that they would have to prove that the illegal modifications caused, or at least contributed to the accident.
however as you say you're not covered if they assess the modification contributed to the accident.

Does that mean if you rear end someone with a turbocharged MX5 they will pay out the other party and repair your front end damage just sans turbo / intercooler?
