by the time you get a solicitor to knock up a threatening letter, the statement of claim, having it filed and served, that'd be $500 already.

Sorry for the late reply, we are actually moving house so i've been packing boxes for a bit.

The car was initially damaged at BDL Car Stereo. The manager then called his mate at New Gel asking if he could do the job. He then asked me if that was okay and i agreed as i had seen some of their previous work and was happy that they would do the job right. New Gel gave me a run down of what they would be doing to the car (sanding back the entire right hand side, respraying and then clear coating). I dropped the car off at New Gel on the Monday and picked it up on Sat morning. I asked to speak with the manager but he was away in Sydney so i told them i would be back on Monday to speak with him directly. On Monday i went back to Fyshwick and vistited 3 other spray painting places to get their opinion. They all said that the job was horrid. I then went to New Gel and pleasantly pointed out my concerns. This is when he abused the crap out of me. I told him i was taking the car to a place that would do the job properly. I went back to BDL and expressed my concerns with the manager as he was paying for the work. he agreed that the job New Gel did was not up to standard and also agreed that i could take it to a place of my choice and then send him the bill. I then went to Prestige Auto in Hume and he agreed to do the work.

I really don't want to go to court but if that it comes down to that i want to be prepared and cover all my bases. I will be getting in contact with a Loss Assessor as you advised and will be getting their written statement. I will also be getting written statements from the 3 different auto spray paint shops that gave me their opinion. At this stage the car is booked in to be resprayed on October 7 but i have spoken with Prestige Auto and they are happy to delay it if necessary.

sounds to me like you've crossed all the T's & dotted all the I's Jimi, as long as the guy who is paying for it is happy to go along, you should be fine........as far as New Gel are concerned, make sure you sh*t on them every time anyone mentions panel work...........court is costly, time consuming, & just occasionally, you don't get the right result.
