eBay seller using one of my mx5cartalk photos to flog his product...

Postby Lokiel » Wed Nov 28, 2018 10:51 pm

Trolling eBay I spotted the following 2 items that looked familiar:
https://www.ebay.com.au/itm/Mazda-MX-5-NB-MX5-Miata-98-05-Aluminium-Chrome-Air-Con-Control-Surrounds-Rings/222434890456?hash=item33ca2712d8:g:xd0AAOSwsupbz0o7:rk:16:pf:0
https://www.ebay.com.au/itm/Mazda-MX-5-NB-MX5-98-05-Dash-Air-Con-Alu-Chrome-Rings-Heater-Control-Surrounds/222434890455?hash=item33ca2712d7:g:pbgAAOSwy-5bz0pu:rk:17:pf:0

The first photo in both of these looked very familiar since it's an SE's centre console surround but the radio fascia is black, not silver, and the head unit looked exactly like the Pioneer unit I installed (see slideshow in first post of http://mx5cartalk.com/forum/viewtopic.php?f=55&t=38070&p=493824#p493824).

The photo is cropped but the dials are all in the same position as one of my slideshow photos and the glare-spots on the head unit are exactly the same.

I bought my HVAC rings from MX5parts in the UK so I'm not sure how I feel about someone using the photo claiming it's their product shown (probably made in the same factory but I don't know that).

A similar thing happened with the blue LEDs I installed, another seller used my mx5cartalk photo and continued to use it when the LEDs were changed to an inferior version which didn't illuminate as well as the original ones I used.

I'm half tempted to post this information on the eBay auctions so that readers are aware of it.

If you took the photo you are the copyright holder and if so you can have it removed.

Not necessarily so. Whilst you did use the EBay policy it will also depend on the T&C's of where the image was taken from.

It's a grey area.
Just send a nice message to the seller to remove the pic. If he doesn't remove it then report him to fleabay.

Just a thought.

The photo from your original thread is a photo bucket link.

Possible the photo in the ebay add could just be a link to the photobucket location.

If you access you PB account and rename/move/delete the original, the one in the ebay add may stop "working".

Of course, if they have actually right-clicked/copied the original from PB and saved on their own PC then uploaded that to the ebay ad then the above will have no impact.

Could be worth a try.

Many ways to have photos in ebay adds - linking to hosted image on external website via HTML tags definitely one of them.
