Fuel Pump Noise?

Hi All,
Just joined the forums here - and just bought an MX-5 last week.
I bought a 2006 NC from a dealer in Sydney. When buying, I noticed a noise behind the passenger seat, even when the car was not in motion. It sounds like a somewhat high pitched whine - near where I would think the fuel pump is.
I pointed this out to the dealer, and they committed (in the purchase contract) to rectify it. They're now trying to tell me that it's normal - and I'm trying to get some advice here. Is fuel pump noise normal?
I'm 100% sure this isn't body/wind noise. I've checked it inside when not moving. It clearly sounds electrical/flow related. It is similar to the noise you hear behind the passenger seat when you switch the car to accessory mode - which sounds like the fuel pump spooling up. It stops in that case, but with the engine running, it is constant.
Any advice?
