take it to a gearbox specialiasts and get them to check it out for you and get their (more than one) opinion.

Pulled the gear shaft out and this is what i found, might be the reason to my troubles.

I'm not sure these would resolve what sound more like synchro problems, but fixing the boots and nylon locator certainly makes the gear changes more firm and removes any floppy play. I'd be changing the gear oil for at least a Redline and you should find the changes improve.
I changed to that that Motorcraft special gear oil, and it has dramatically improved my changes in what was already a fairly smooth gearbox. Oil quality can make a big difference.

Can you PLEASE share where you managed to find the motorcraft gearbox fluid? I searched the entire Internet to find somewhere that would ship to aus or is located in aus...

My na8 5speed dropped 1st, 3rd and 5th randomly last year. After having lots of difficulty getting it into 5th then problems with it popping out when not under load.
Pretty sure random short shift kit had something to do with it.
1.5k later and I've got a "new" used 5speed nb box, new clutch and spigot bearing fitted and a mazdaspeed short shift kit, despite a bit of work and some fussing around sourcing the GB it's been simple.
By all means try the above suggestions but its also nice piece of mind to just start over.
